BTS Case, Former BPK Member Achsanul Qosasi Sentenced to 5 Years Bui

Former Member III of the Audit Board (BPK) of the Republic of Indonesia 2019-2024 Achsanul Qosasi was charged with five years in prison and a fine of IDR 500 million subsidiary to six months in prison.

Prosecutors assessed that Achsanul had been proven to have committed extortion worth IDR 40 billion related to corruption cases involving the provision of 4G Base Transceiver Station (BTS) towers and supporting infrastructure 1, 2, 3, 4 and 5 of the Telecommunication and Information Accessibility Agency (BAKTI) of Kominfo.

“The sentence against the defendant Achsanul Qosasi in the form of imprisonment for 5 years is fully reduced by the detention period that has been carried out by the defendant with an order that the defendant remain detained in the detention center,” said the prosecutor when reading out the criminal charges at the Jakarta District Court, Tuesday (21/5).

Achsanul is considered proven to have violated Article 12 letter e of the Corruption Eradication Law (UU Tipikor) as in the first indictment of the public prosecutor.

The prosecutor also presented a number of aggravating and mitigating matters. The aggravating thing is that Achsanul does not support government programs in the context of running a clean and free country from corruption, collusion and nepotism or KKN.

Achsanul’s actions have resulted in a decline in the level of public trust in high state institutions.

Mitigating matters were that Achsanul was polite during the trial, admitted frankly to the acts charged, and had never been convicted before.

“The defendant has returned the entire money that has been received unlawfully in the amount of US $ 2,640 million which is equivalent to Rp40 billion,” the prosecutor said.

In addition, the prosecution also demanded the panel of judges to sentence Sadikin Rusli as Achsanul’s confidant to four years in prison and a fine of IDR 200 million subsidiary to three months of confinement. One of the reasons for the lighter prosecution is because Sadikin did not enjoy the proceeds of the crime.

The IDR 40 billion received by Achsanul came from the Director of PT Multimedia Berdikari Sejahtera Windi Purnama with the source of money from the Commissioner of PT Solitech Media Sinergy Irwan Hermawan. The provision of money was ordered by the President Director of BAKTI Kominfo Anang Achmad Latif. The three names were also prosecuted by the Attorney General’s Office.
